Welcome to Top Pop Collectibles (“Top Pop Collectibles,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of mytoppop.com, our storefronts, social selling channels, live sales, marketplace listings, and any related products or services (collectively, the “Services”).

By accessing or using our Services, placing an order, or purchasing any product from us, you agree to be bound by these Terms, our Final Sale / Refund Policy, our Shipping Policy, and our Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Services.

1. Eligibility

You must be at least the age of majority in your state or province of residence to use the Services or place an order. By using the Services, you represent that you meet this requirement.

2. Products and Listings

We sell trading cards, graded cards, sealed product, accessories, collectibles, and related merchandise.

We strive to describe and photograph products as accurately as possible; however:

  • product images are for illustration and may vary in color or appearance depending on screen/device settings;
  • packaging, print quality, centering, factory defects, seal condition, and other manufacturer-related variations may occur;
  • raw cards are sold ungraded, and we do not guarantee any specific grading outcome from PSA, CGC, BGS, or any other grading company;
  • graded cards are sold based on the grade assigned by the third-party grading company. Case scuffs, minor label variations, or slab-holder imperfections that do not affect the assigned grade may be present.

We reserve the right to correct listing errors, pricing errors, inventory inaccuracies, or descriptive mistakes at any time, including after an order is placed.

3. Orders

Your order is an offer to purchase. We reserve the right, in our sole discretion, to accept, reject, limit, cancel, or refuse any order for any lawful reason, including suspected fraud, pricing or inventory errors, payment issues, suspected resale abuse, or suspected violations of these Terms.

An order is not final until payment is authorized and we accept the order.

We may limit quantities per customer, household, address, payment method, or order.

4. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice.

You agree to provide current, complete, and accurate billing, shipping, and payment information. By submitting payment information, you represent that you are authorized to use the payment method provided.

Applicable taxes, shipping charges, duties, customs fees, carrier surcharges, and other government-imposed or transaction-related charges may be added at checkout or collected after checkout where applicable.

5. Final Sale; No Return Rights Except as Expressly Stated

All purchases are subject to our Final Sale / Refund Policy. Except as expressly stated in that policy or as required by applicable law, all sales are final and we do not accept returns, exchanges, or refunds.

6. Shipping and Risk of Loss

All shipping and delivery terms are governed by our Shipping Policy.

To the fullest extent permitted by law, title to and risk of loss for products pass to the customer when the shipment is delivered to the carrier. We are not responsible for carrier delays, weather events, customs delays, or losses caused by incorrect addresses provided by the customer.

7. Preorders

From time to time, we may offer preorder products. Preorder release dates, allocation dates, and shipping dates are estimates only and may change due to manufacturer, distributor, or carrier delays. We do not guarantee any specific release or delivery date for preorder items.

If your order contains both in-stock items and preorder items, we may hold the order and ship all items together unless otherwise stated.

We reserve the right to cancel preorder items and issue a refund if inventory is unavailable, allocations are reduced, or fulfillment becomes impracticable.

8. Marketplace, Live Sale, and Social Channel Sales

These Terms also apply to purchases made through our live sales, livestreams, social channels, and supported third-party marketplaces to the extent permitted by those platforms’ rules. In the event of a conflict between these Terms and mandatory platform rules, the applicable platform rules will control only to the extent required.

9. Prohibited Conduct

You agree not to:

  • use the Services for unlawful purposes;
  • interfere with the operation or security of the Services;
  • use bots, scraping tools, or automated methods to access the Services without our written permission;
  • submit false payment, identity, or shipping information;
  • abuse refund, replacement, cancellation, or chargeback processes.

10. Chargebacks and Payment Disputes

If you believe there is a problem with your order, you agree to contact us first at info@toppopcollectibles.com so we have an opportunity to resolve the issue.

If a customer initiates a chargeback or payment dispute for an order that was accurately described, properly delivered, or otherwise consistent with these Terms and our policies, we reserve the right to provide order records, shipping records, delivery confirmation, photos, communications, and other evidence to the payment processor or platform in defense of the transaction.

We also reserve the right to refuse future orders from customers who abuse chargebacks, claims, returns, or cancellation processes.
